What is the SIPSI declaration?
When you temporarily secondment employees to France, it is essential to file a SIPSI declaration in advance. SIPSI, the French declaration system for international services, ensures that you share the necessary information about the posting with the French authorities. This obligation was created to strengthen compliance with legal provisions and combat illegal employment.
The SIPSI declaration includes various data, such as:
- Personal details of the employee, including copy of the employment contract.
- The intra-community VAT number of the employer.
- Contact details of a representative in France.
- Information on wages, social security and place of residence.
Penalties for non-compliance?
Besides filing the declaration, you must also appoint a representative on French territory. This person is the contact point for the French inspection services and must always have access to certain documents, such as the posting certificate and payslips. Failure to comply with these obligations can result in high fines of €2,000 per employee, up to as much as €4,000 per employee if repeated.
