Secondment of a self-employed person
Working in France as a self-employed person
what should I take into account?
Going self-employed across borders brings its own challenges and formalities. It is not just a matter of continuing your work in another country. There are important rules and documents you need to consider in order to be legally compliant. Make sure you are not caught by surprise and let us inform you what is required.
What documents are needed?
- Presence of a valid A1-certificate
- Availability of a building contract
- Proof of registration/registration of legal entity
- No SIPSI-reporting obligation
- No BTP-card obligation
This list is not exhaustive. Please note that during a labour inspection, the labour inspectorate has the right to request additional documents.
Presence A1-certificate
The A1-attestation is a certificate that shows that a worker is socially insured in the country where he or she is employed. It is mainly used in the European Union, the European Economic Area (EEA) and Switzerland, and it is part of European social security regulations. It ensures that you would not pay double social security contributions, in another European Union country.
Construction agreement
Proving a contracting agreement proves that a binding contract exists in which you commit to perform specific work for a client. Such an agreement provides clarity and protection for both parties: the client and the contractor.
Proof of registration
If you are self-employed, you must also be registered. It is important that you have proof of registration to hand when you start working in France.
A best practice is to put a printed copy in your car. Zou can avoid you uncomfortable situation.
